摘要
生成式AI的输出是否享有第一修正案的保护？我们倾向于肯定。尽管当前的AI程序当然不是人，本身不享有宪法权利，但其言论可能因程序创作者的权利而受到潜在保护。但除此之外，且可能更为重要的是，AI程序的言论应因其用户的权利而受保护——既包括用户的聆听权，也包括用户的发言权。在这篇短文中，我们勾勒了这一分析的轮廓。
